Foods of Minimal Nutritional Value (FMNV)
Foods of Minimal Nutritional Value (FMNV) Policy (TAC Title 4 Pt. 1 Ch. 26 Sub Chapter A§26.2) Definitions:
Foods of Minimal Nutritional Value (FMNV): The four categories of foods and beverages are:
(1) Any carbonated drink
(2) Water ices (popsicles, snow cones)
(3) Chewing gun
(4) Candy – hard, jellies, marshmallow, fondant, licorice, spun candy, candy-coated popcorn
Foods of Minimal Nutritional Value (FMNV) Policy (TAC Title 4 Pt. 1 Ch. 26 Sub Chapter A§26.3) Elementary Schools:
(1) Elementary school campuses may not serve or provide access for students to FMNV and all other forms of candy at any time anywhere on school premises until the end of the last scheduled class.
(2) FMNV may not be sold or given away to students on school premises by school administrators or staff (principals, coaches, teachers, etc.); students or student groups; parents or parent groups; guest speakers; or any other person, company or organization.
Competitive Foods and Snacks
An elementary school campus may not serve competitive foods (or provide access to them through direct or indirect sales) to students anywhere on school premises throughout the school day until the end of the last scheduled class except for those food items made available by the school food service department.
